Terms of Service
Last Updated: October 9, 2026
Welcome to Food Signals. Food Signals is owned and operated by Naked Noodle Pty Ltd, an Australian company ("Food Signals", "we", "us" or "our"). These Terms of Service ("Terms") are the agreement between you and us for your use of our website, web application and mobile application (together, the "Service"). Please read them carefully. By creating an account, accepting an invitation or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms take effect for people who create an account after the date above when they create it, and for existing account holders 14 days after we notify them, as described in Section 12.
Your consumer rights are not affected. Nothing in these Terms takes away rights that the law says cannot be taken away by contract, including your rights under the Australian Consumer Law if it applies to you. Sections 8 and 9 explain this.
1. Nature of the Service
Food Signals is an informational tool that:
- Provides meal suggestions tailored to individuals on GLP-1 medication.
- Accepts dose timing and relative changes e.g. same, increase, decrease to help calculate injection cycle timing.
- Uses artificial intelligence to generate meal recommendations and answer dietary questions.
Critical limitations you must understand:
- Not a medical device: The Service is not a medical device, clinical decision support tool, or regulated health product. It has not been evaluated or approved by the US Food and Drug Administration, the Therapeutic Goods Administration, or any equivalent regulatory body.
- Not medical advice: Nothing in the Service — including any AI-generated response — constitutes medical advice, diagnosis, or treatment. You must not rely on this Service as a substitute for professional medical supervision of your GLP-1 medication.
- Not for emergencies: The Service is not monitored for emergencies. If you think you may have a medical emergency, call your local emergency number (000 in Australia, 911 in the United States) or your doctor straight away.
- No doctor-patient relationship: Your use of the Service — including any optional data-sharing with a Food Signals dietitian described in our Privacy Policy — does not create a doctor-patient, physician-patient, dietitian-patient, or other clinical or therapeutic relationship between you and Food Signals, its personnel, or any contractor. We are not your healthcare provider. No content in the Service, including AI-generated responses, logged patterns, or meal suggestions, is provided as part of, or a substitute for, the clinical relationship you have with your own treating doctor, dietitian, or other licensed healthcare professional. You remain responsible for your healthcare decisions and for following the advice of a licensed provider in your jurisdiction. Nothing in this paragraph limits any duty that a health professional owes you under the law or the rules of their profession.
- No medication data collected: We do not collect the name, brand, type, or identity of your medication. The Service accepts only timing and relative changes, which it uses solely to calculate cycle timing. Any reference to "GLP-1 medication" in the Service is informational only.
- Allergies and ingredients: Meal suggestions, recipes, nutrition figures and ingredient information may contain errors, and the Service may not correctly apply the allergies, restrictions or dislikes you have entered. Always check ingredients and product labels yourself before you prepare or eat anything, particularly if you have a food allergy or intolerance.
- Verification obligation: AI-generated meal recommendations and cycle timing estimates are subject to error. You are responsible for verifying any information provided by the Service with your healthcare provider before acting on it.
2. Waiting List, Invitations and Accounts
Who can use the Service. You must be at least 18 years old to create an account or use the Service.
Waiting list. Food Signals is available by invitation. You can ask to join our waiting list. Joining the waiting list does not give you an account or a right to use the Service, and we are not obliged to admit any person, or to admit people in any particular order or by any particular date.
Invitations. When we admit you, we will email you an invitation to create an account. An invitation is personal to you, can be used once, and expires 30 days after we send it (if it expires, you can still create an account using the email address we admitted, or ask us to send another). You must not sell, share, publish or transfer an invitation. We may withdraw an invitation that has not yet been used.
Your account. To use the Service you must have an account. You agree to:
- Provide accurate, complete, and current registration information.
- Hold one account only, for your own use.
- Maintain the security of your account credentials and not share them with any third party.
- Notify us immediately of any suspected unauthorised access to your account.
You are responsible for activity conducted under your account, except to the extent it results from our failure to take reasonable care of the security of the Service. You may delete your account at any time from within the app; deleting it erases your data as described in our Privacy Policy. Section 11 explains when we may suspend or close an account.
3. Access Levels, Trial and Access Codes
3.1 Trial. When you create your account from an invitation, you receive full access to the Service for 14 days from the day your account is created (or whilst in eary launch period, 14 days from when payments are introduced). We do not ask for a card or any payment details to start your trial, and your trial does not turn into a paid plan.
3.2 Basic. When your trial ends, and unless you hold another period of full access, your account continues on "Basic" at no charge. Basic includes our everyday tools for logging and understanding what you eat, and the meal planner. Basic does not include every feature of full access. The app shows you which features your account has at any time.
3.3 Nothing you have made is taken away. If your access changes, we do not delete what you created: your logs, saved recipes and products, meal photos, plans and household settings remain, and you can still view and use them as described in the app. If full access returns, your household settings apply again without you re-entering them. Your rights to export your data and to delete your account are not affected by your access level.
3.4 Existing accounts. If your account was created before we introduced the waiting list and access levels, you keep full access at no charge for as long as we operate the Service, subject to these Terms (including Sections 6, 10 and 11).
3.5 Access codes. From time to time we may give a person a private access code. A code is personal to the person it was given to and has no cash value. You must not sell, share, publish or transfer a code, and you must not use more than one code, or create more than one account, to obtain access periods you are not entitled to. Redeeming a valid code lets you create an account without waiting and gives you full access for the period we tell you when you redeem it. We may disable a code at any time to stop further redemptions; doing so does not shorten a period already granted, unless the code or the period was obtained or used in breach of these Terms, in which case we may end it.
3.6 Payment. We do not currently charge for the Service. If we introduce paid plans, we will tell you first. We will not charge you unless you have chosen a paid plan and agreed to its price and terms at that time, and we will not collect payment details from you without your clear agreement.
3.7 Changes to what each level includes. We may change what Basic and full access include. If a change makes the access you currently have materially worse, we will give you notice under Section 12 before it takes effect, except where a change is needed for legal, security or safety reasons or to stop abuse.
4. Third-Party AI Model Processing
You acknowledge and agree that:
The AI-assisted features of the Service operate by transmitting your queries and related context to a third-party AI model provider. This is an integral and necessary part of the Service — AI-generated responses cannot be produced without this transmission.
The current AI model provider is:
- OpenAI (openai.com) — GPT family of AI models
This is the only AI model provider currently integrated into the Service.
By using the AI-assisted features, you agree to your queries being transmitted to this provider for processing. Our Privacy Policy sets out what is sent, what is not sent, and the protections that apply to it, including that your query data is not used to train AI models and that the provider may keep it for up to 30 days to detect and prevent abuse of its service. Where a law requires us to ask for your consent in a particular way before we collect or share health information, we ask for it in that way and these Terms do not replace it.
Changing providers. If we add or change an AI model provider, we will update this section and our Privacy Policy and notify you before the new provider receives any of your data. We will give at least 14 days' notice, unless a shorter period is needed to keep the Service secure or running.
As AI providers operate globally, your data may be processed outside your country of residence. Our Privacy Policy provides further detail on data flows and protections.
5. Data Use — No Sale of Your Data
We do not sell, rent, license, or otherwise commercially exploit your personal data.
We use your data to:
- Deliver the Service to you — generating meal recommendations, answering queries, and calculating your injection cycle schedule.
- Operate and improve the Service — including internal monitoring of service reliability.
- Administer the waiting list, invitations, access levels and access codes described in Sections 2 and 3.
- Communicate with you about your account and, if you have opted in, send you our email updates.
Our Privacy Policy describes each of these uses in full, and names every service provider that handles your data for us and why. We do not disclose your personal data to anyone else, except where the law requires us to.
This data use commitment is a material term of this agreement. If these Terms and the Privacy Policy differ about how we handle your personal data, the Privacy Policy applies.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or extract the source code or AI prompts underlying the Service, except to the extent the law gives you a right to do so that cannot be excluded.
- Introduce malware, interfere with, or disrupt the Service or its infrastructure.
- Use the Service to process or store information belonging to third parties without their consent.
- Represent or imply that the Service provides medical advice or medical device functionality.
- Circumvent any access controls, rate limits, or technical measures we implement.
- Sell, share, publish or transfer an invitation or an access code, use another person's invitation, or create more than one account to obtain additional trials or access periods.
If you breach this section we may suspend or close your account, and end any access period we granted, as described in Section 11.
7. Intellectual Property and Your Content
All software, design, trademarks, and content comprising the Service remain our exclusive property or that of our licensors. These Terms do not transfer any intellectual property rights to you. We give you a personal, non-transferable, revocable right to use the Service for your own household, non-commercial purposes, in line with these Terms.
You retain ownership of the data and content you put into the Service, including your logs, meal photos, and recipes and products you save. By using the Service, you grant us a limited, non-exclusive licence to host, store and process that content for the purpose of providing the Service to you, consistent with our Privacy Policy. The licence ends when you delete the content or your account, subject to the retention periods in the Privacy Policy.
You are responsible for having the right to add what you add. If you save or import a recipe or other material that someone else created, keep it for your own personal use.
8. Your Consumer Rights and Our Disclaimers
8.1 Rights that cannot be excluded. Consumer protection laws in many places give you rights and guarantees that cannot be excluded, restricted or modified by contract. In Australia, the Australian Consumer Law gives consumers guarantees about services, including that they will be provided with due care and skill, and remedies if those guarantees are not met. Nothing in these Terms excludes, restricts or modifies any of those rights, guarantees or remedies. Everything else in this Section 8 and in Section 9 applies only to the extent those laws allow.
8.2 Disclaimers. Subject to Section 8.1:
- No medical warranty: We make no representation or warranty that the Service's meal recommendations, cycle timing estimates, or AI-generated responses are accurate, complete, or appropriate for your individual medical circumstances. Always consult a qualified healthcare professional.
- AI accuracy: AI-generated content may contain errors, omissions, or outdated information. We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content.
- Service availability: We do not guarantee that the Service will be available at all times, free from errors, or uninterrupted.
- No other warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". EXCEPT AS SET OUT IN SECTION 8.1, WE GIVE NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Some places do not allow implied warranties to be excluded, so some of this paragraph may not apply to you.
9. Limitation of Liability
9.1 What is never limited. Nothing in these Terms excludes or limits:
- your rights, guarantees and remedies described in Section 8.1;
- our liability for fraud or deliberate wrongdoing;
- our liability for death or personal injury caused by our negligence, where the law that applies to you does not allow that liability to be excluded or limited; or
- any other liability that cannot lawfully be excluded or limited.
9.2 Limits that apply otherwise. Subject to Section 9.1, and to the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential, or punitive loss or damage arising from your use of the Service.
- We are not liable for loss or harm to the extent it results from decisions you make about your medication or medical care, from acting on content in the Service without checking it as Section 1 asks you to, or from inaccurate information you gave us.
- Our total aggregate liability to you for all claims arising under or in connection with these Terms or the Service shall not exceed the greater of (a) the total fees (if any) paid by you in the 12 months immediately preceding the event giving rise to the claim, and (b) 100 Australian dollars.
9.3 Your liability. Your liability to us is reduced to the extent that we caused or contributed to the loss.
10. Changes to the Service
We may modify, suspend, or discontinue any feature of the Service at any time, subject to Section 3.7. We will use reasonable efforts to notify you of material changes. Where we discontinue the Service entirely, we will provide at least 30 days' written notice, so that you have time to export your data.
11. Suspension and Ending This Agreement
By you. You can stop using the Service at any time, and you can end this agreement at any time by deleting your account from within the app.
By us. We may suspend or close your account, or end an access period we granted, if you seriously or repeatedly breach these Terms, if we reasonably believe it is necessary to protect you, other people or the Service, or if the law requires it. Where it is reasonable to do so we will tell you why and give you a chance to put things right first. If you think we have made a mistake, contact us and we will review it.
What happens afterwards. When this agreement ends, your right to use the Service ends. Our Privacy Policy explains what happens to your data, and your rights to export and delete it continue to apply. Sections 1, 7, 8, 9, 13 and 15 continue to apply after this agreement ends.
12. Changes to These Terms
We may update these Terms from time to time. We will provide at least 14 days' notice of material changes by email or in-app notification before they take effect. We may make a change sooner where the law, or the security of the Service, requires it, and we will tell you as soon as we reasonably can.
If you do not agree to a change, you can stop using the Service and delete your account before it takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. A change does not apply to a dispute that arose before it took effect.
13. Governing Law and Disputes
These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any dispute arising under these Terms. If you are a consumer living in another country, this does not take away any protection that the mandatory consumer laws of the place where you live give you, or any right you have to bring a claim in your local courts.
Before commencing formal proceedings, both parties agree to attempt in good faith to resolve disputes informally within 30 days of written notice of the dispute. This does not stop either of us seeking urgent court orders, and it does not stop you complaining to a consumer protection or privacy regulator at any time.
14. Apple App Store
If you downloaded our app from the Apple App Store, the following also applies:
- These Terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Your licence to use the app is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any warranty that applies to it, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, consumer protection, privacy or similar claims, and claims that the app infringes someone else's intellectual property rights.
- You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply to you when you use the app, such as your mobile data agreement.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
15. General
- Whole agreement. These Terms, together with our Privacy Policy and any terms you agree to when you choose a paid plan, are the whole agreement between you and us about the Service.
- If part of these Terms cannot be enforced. If a court finds that part of these Terms is invalid or cannot be enforced, that part is read down or removed to the extent necessary, and the rest continues to apply.
- Transfer. You may not transfer your account or your rights under these Terms to anyone else. We may transfer our rights and obligations to another organisation that takes over the Service; we will tell you if that happens, the commitments in Section 5 and in our Privacy Policy continue to apply to your data, and you can delete your account if you do not want to continue.
- No waiver. If we do not enforce a part of these Terms straight away, that does not mean we have given up the right to do so later.
